This white paper, produced by the CARO Centre in collaboration with Watson Farley & Williams and the Global Alliance of Impact Lawyers, examines considerations for the effective implementation of the Conflict Management Committee (“CMC”) Rules. The CMC Rules are an innovative framework designed to support conflict prevention, stakeholder engagement and ESG risk management in infrastructure and energy transition projects.
Drawing on insights from a series of multi-stakeholder roundtable discussions, the paper identifies key considerations for the successful adoption of the CMC Rules, including:
- early implementation;
- cost predictability;
- training; and
- guidance and government support.
The paper also explores how the CMC Rules can complement existing dispute resolution mechanisms.
