Franck Poindessault is a partner in the Dispute Resolution Group.

Franck has over 20 years of experience in advising and representing French and international companies, as well as banks and financial institutions, in business and liability disputes settled before judicial and arbitral courts and/or with alternative dispute resolution methods such as mediation.

His practice includes disputes relating to the validity, execution and termination of contracts, as well as disputes relating to economic law (sudden termination of established business relationships, unfair competition, significant imbalance, etc.), corporate law (shareholder disputes, litigation resulting from mergers and acquisitions) and management liability.

In addition, he has developed a practice in the firm’s key sectors: energy and transport. Franck works in these sectors alongside the firm’s specialised teams, both upfront to reduce contractual risks, and at the dispute resolution stage.

Franck also has specific expertise in insurance law, of which he is a specialist recognized by the French National Council of Bars (Conseil National des Barreaux). In this respect, he assists companies in covering their damage and liability risks – in particular Professional Civil Liability, construction risks (including in the energy sector), industrial risks, financial risks (covering in particular the liability of their management, the employer’s liability, and the risks related to fraud, embezzlement, governance and cybersecurity), risks of banks and financial institutions.

Franck began his career in law firms acting before France’s Highest Court and then worked in French and international law firms. He is also a member of professional associations [International Chamber of Commerce (ICC), the French Association for the Management of Risks and Corporate Insurance (AMRAE), ARIAS France (formerly CEFAREA) and the French Association of Insurance and Reinsurance Lawyers (AJAR)].

Sa pratique englobe les litiges relatifs à la validité, l’exécution et la résiliation des contrats, ainsi que ceux afférents au droit économique (rupture brutale des relations commerciales établies, concurrence déloyale, déséquilibre significatif, etc.), au droit des sociétés (litiges entre actionnaires, contentieux résultant d’opérations de fusions & acquisitions) et à la responsabilité des dirigeants.

Il a également développé une pratique dans les secteurs clés du cabinet : l’énergie et les transports. Franck intervient ainsi dans ces secteurs aux côtés des équipes spécialisées du cabinet aussi bien en amont pour réduire contractuellement les risques, qu’au stade du règlement des litiges.

Franck a également une expertise spécifique en droit des assurances, dont il est un spécialiste reconnu par le Conseil National des Barreaux. A cet effet, il accompagne les entreprises pour la couverture de leurs risques de dommage et de responsabilité – notamment la Responsabilité Civile Professionnelle, les risques de construction (y compris dans le secteur de l’énergie), les risques industriels, les risques financiers (couvrant notamment la responsabilité des dirigeants, la responsabilité de l’employeur, les risques de fraudes et détournements, les risques de gouvernance, les risques cyber), les risques des banques et institutions financières.

Franck a commencé sa carrière en cabinet d’avocats aux Conseils puis a travaillé au sein de cabinets français et internationaux et est membre d’associations professionnelles [Chambre de Commerce international (CCI), l’Association pour le Management des Risques et des Assurances de l’Entreprise (AMRAE), ARIAS France (anciennement le CEFAREA et l’Association des Juristes d’Assurance et de Réassurance (AJAR)].
