FELIX IS HEADING THE GERMAN PUBLIC LAW & COMPETITION GROUP.

He specialises in administrative, public procurement and state aid law. His practice focuses on providing comprehensive advice on infrastructure and digitisation projects with an industry focus on education & research, health, mobility, utilities & waste management, and telecommunications.

Felix advises on the financing of projects involving available public funding, and on the structuring of organisations. In addition, he assists in the structuring and implementation of national and EU-wide procurement procedures (construction, supply and services) as well as competitive procedures (concessions, investor selection procedures and public-private partnerships), including the drafting of service-specific contracts and negotiations. He also advises bidders on their participation in public procurement procedures. He represents both contracting authorities and bidders in review proceedings and other disputes. He further advises on industry-specific regulatory issues in transactions.

Felix is recognised as a leading lawyer in the field of public procurement law in Legal500 (Germany), where clients highlight his “personal and matter-focussed advice” as well as “clear language, quick work ” and “high expertise”. He is a lecturer for public procurement law at the University for Public Service in Bavaria.

His clients include federal and state ministries, local authorities as well as municipalities and public institutions such as infrastructure companies, municipal and public utilities as well as private companies, banks and investors.

  • Advising Federal Office for Equipment, Information Technology and Services of Bundeswehr (BAAINBw) on the phase out and transfer of a complex PPP structure with industrial partners into an in-house solution for the entire IT services for the Bundeswehr including structuring and implementation of EU-wide tenders for subcontractors (project volume > EUR 7 billion)
  • Advising various hospital operators on the structuring and implementation of tenders, e.g. hardware and software as well as services for the digitalisation of clinical operations, under the state funding provided by Hospital Future Act (Krankenhauszukunftsgesetz)

Er ist spezialisiert auf das Wirtschaftsverwaltungs-, Vergabe- und Beihilfenrecht. Sein Tätigkeitsschwerpunkt liegt auf der ganzheitlichen Beratung von Infrastruktur- und Digitalisierungsvorhaben mit einem Branchenfokus auf Bildung & Forschung, Gesundheit, Mobilität, Ver- & Entsorgung sowie Telekommunikation.

Er berät zur Finanzierung von Vorhaben unter Berücksichtigung verfügbarer staatlicher Fördermittel und bei der Strukturierung von Organisationsformen. Zudem begleitet er die Konzeptionierung und Durchführung von nationalen und europaweiten Vergabeverfahren (Bau-, Liefer- und Dienstleistungen) sowie wettbewerblichen Verfahren (Konzessionen, Investorenauswahlverfahren und öffentlich-private Partnerschaften) nebst Gestaltung der leistungsspezifischen Vertragswerke und Durchführung von Verhandlungen. Zudem berät er Bieterunternehmen bei der Beteiligung an Vergabeverfahren. Er vertritt sowohl Auftraggeber als auch Bieter in Nachprüfungsverfahren und sonstigen Auseinandersetzungen. Zudem berät er bei Transaktionen zu branchenspezifischen regulatorischen Fragen.
