International Arbitration Experience
- US$200 million LCIA arbitration arising from the termination of a contract for the engineering, procurement, installation and commissioning ("EPIC") of an oil and gas processing platform. Key issues included the EPIC contractor's safety breaches and breaches in relation to the staffing and completion of the work and the engineering and commissioning of the platform.
- Defending the Government of India in what has been described as the world's largest investment treaty arbitration. The multi-billion dollar claim concerns the Dabhol electricity power station in Maharashtra which was built by a US consortium led by Enron, GE and Bechtel. The claim is brought by Mauritian subsidiaries of the US corporations under a Bi-Lateral Investment Treaty between Mauritius and India.
- Vivendi/T-Mobile - Polish Telecom Arbitration - continuing to act for Vivendi and its Polish telecoms partner, Elektrim SA in two connected arbitrations with T-Mobile over a 51% block of shares in Central Europe's largest mobile phone operator PTC (worth over US$1.1bn). These are two of the largest arbitrations in Europe at present.
- Acting in Deutsche Bank v. International Industrial Bank (and Others) - acting for IIB (a Russian bank) who are defendants in an international arbitration (London & Moscow) brought by Deutsche Bank/Bankers Trust. The claim is worth approximately CHF200m and relates to loans made by the claimant to the City of Moscow. The case is also a leading case in the confidentiality of London Arbitration awards and was subject to a hearing in the Court of Appeal where we defeated the City of Moscow's application to have reporting restrictions lifted.
- LCIA London Arbitration - acting for major offshore exploration company in a construction dispute relating to an oil platform in South East Asia.
- ICC Arbitration in Singapore - acting for Norscan on an engineering dispute arising out of the supply and installation of power generation equipment for use on a pulp and paper mill in Indonesia.
- Metal smelting arbitration - acting in a major London arbitration for one of the world’s largest metal producers concerning a joint venture with state owned metal smelter in an FSU state
- Acting for Hagura Mining, Zambia's leading mining company, in its multi-million dollar dispute with the government of Zambia.
- Acting for MT Maritime in a dispute with one of Spain’s largest ship yards in one of the largest shipbuilding disputes currently being heard in London. The matter also involves parallel High Court proceedings against the shipyard’s guarantor banks and is a leading case on performance guarantees. Reported as Caja de Ahorros v Gold Coast [2002] EWCA Civ 1086
- Advising Advance Agro in a very substantial Singapore based ICC arbitration with Kvaerner arising out of the construction of two power plants in Thailand. This is one of the largest arbitrations recently heard in Singapore.
- Acting for a major US and international oil refinery software provider, in a London Arbitration. The dispute concerns rights to a multi million dollar software programme and also involves multi-jurisdictional actions in the English and Texan Courts.
