IP is a broad concept. It includes your rights of ownership of intangible business assets such as creativity, goodwill, know-how, technology and reputation. The most familiar aspects of IP are trade marks, patents, copyright and rights relating to ownership of designs. But there are numerous other areas where the scope of intellectual property protection is still expanding.
IP is not a single, clearly self-contained subject; in fact it plays an important part across a whole range of business areas. This is why our dedicated IP team is part of our Corporate Group where IP issues are seen and can be dealt with in a broader business context.
As well as offering advice on a whole range of IP related problems and transactions the team provides a full corporate service, including taxation and employment advice, in areas that have a high IP content such as technology start ups, funding, IPOs and M&As. Similarly, our finance teams have accumulated a great deal of experience in evolving ways to release value locked up in your existing IP assets.
Although we attempt to find commercial solutions to disputes that arise regarding the use and alleged infringement of intellectual property rights (ideally to the mutual benefit of all parties), sometimes litigation is unavoidable. Our litigation department has a broad experience of prosecuting and defending IP disputes.
