Watson Farley & Williams has always been a leading international finance practice, but in recent years we have developed a finance litigation group which matches our non-contentious practice. We now act on complex disputes for many substantial banks and financial institutions.
The disputes we handle often involve parallel litigation in several jurisdictions and we have developed a particular expertise in managing this type of case.
For example, we recently acted for the London branch of a German bank in a multi-million dollar claim which involved the appointment of English and foreign receivers over property situated in several jurisdictions on the basis of a Material Adverse Change clause under English law security documents. The case involved bringing emergency anti-suit proceedings in the English Courts, related insolvency proceedings in the Bermuda Courts and, finally, the successful defence of a related action brought by bondholders in the New York Courts under a Bond Indenture governed by New York law.
