European Union
The law of the European Union ("EU") now intrudes, at some level, on every area of commercial activity within Europe.
Our lawyers have considerable experience of working with, and within, the EU’s institutions located in Brussels, Luxembourg, etc. Other than competition law, we have particular expertise with regard to advising on the following areas of EU law:
General
- EU law relating to the free provision of services, freedom of establishment, free movement of capital and the free movement of workers
- Banking and securities regulation and harmonisation provisions
- EU transport policy, in particular as it relates to shipping and aviation
- EU environmental and health and safety issues, including product liability and liability for environmental damage (see also additional description set out below)
- The impact of EU law and policy on a client’s overall strategic planning and particularly relating to distribution networks, joint ventures and mergers and acquisitions, etc
Regulatory and environmental
- Advising clients with regard to the environmental law and policy of the EU (e.g. waste, energy, pollution liability, etc.)
- Compliance assistance with the various systems of product certification, take-back and design requirements
- Providing advice concerning the EU’s policy controlling dangerous substances, preparations and chemicals generally (e.g. plant protection products, biocides, etc.)
- Provision of reports on the state of the law within the EU, and/or certain Member States of the EU, on particular areas of regulatory control
- Assistance with lobbying campaigns designed to persuade the EU’s legislative bodies to change, adopt or abstain from the adoption of EU legislation
Public procurement
- Bespoke compliance advice on procurement law (i.e. whether it is necessary to publish in the EU’s Official Journal, etc., and then how to ensure compliance from publication to award)
- Advice with regard to the commercial risks to consider when assessing infringements of the rules and the disputes that might arise as a result
- Assistance with the impact of legislative change
- Advice on the application of procurement rules with regard to corporate restructuring/reorganisation.
