The US$4 billion dollar claim arose out of the Dabhol Power Project in Maharashtra which was built by a US consortium led by Enron, GE and Bechtel (represented by Jack Kerr of Simpson Thacher New York). Further advising the Government of India on the overall settlement of the complex Dabhol disputes which had been ongoing for the last five years and negotiating two separate settlements with GE and Bechtel Acting for BGB in the defence of a substantial claim of US$35 million bought by Ace Bermuda who were the political risks insurer of a CDO ecuritization. The case concerns emerging market CDOs and complex questions of Chinese and Malaysian law. This is one of the largest banking cases in the Commercial Court in 2006 Acting on the defence of a £130 million judgment against the Republic of Congo. Claim bought by US Vulture fund (Kensington) This is a leading case on sovereign liability and the ability to enforce English judgement against companies allegedly controlled by States Acting for one of the world’s major offshore exploration company in a construction dispute relating to an oil platform in South East Asia built by Hyundai Acting for Vivendi and its Polish subsidiary (ElektrimTelco) in a series of connected arbitrations for control of Central Europe’s largest mobile telephone operator PTC valued at €2bn Acting for an Italian company SANA in long running High Court (and Court of Appeal) proceedings against the Brazilian state oil company Petrobras advised by Linklaters.
