After training with the firm in London, Mark spent six years in the International Litigation and Arbitration group in the firm’s Singapore office before relocating to London in 2015. He specialises in international arbitration and commercial litigation, with a focus on shipbuilding, oil & gas construction, charterparty and commodity disputes.

Experience Open

    Mark’s experience includes:
    • Representing an international investment bank in a case concerning substantial close out payments under the 1992 ISDA Master Agreement.
    • Acting for contractors engaged on EPC terms to supply process modules for installation on a FPSO, with particular reference to issues arising out of variation orders, liquidated damages claims, extensions of time and concurrent delay.
    • Assisting in a claim against the insurers of a jack-up rig in respect of serious damage sustained during the dry-tow of the rig around the Cape of Good Hope, dealing with warranty and exclusion clause issues.
    • Advising a shipowner/charterer in connection with a variety of issues arising out of restructuring arrangements with its creditors necessitated by the collapse of the dry bulk market.
    • Acting on an ICC arbitration for an AIM/ASX-listed oil exploration and development company in a claim under a parent company guarantee against the Indonesian parent company of the client’s farm in partner.
    • Acting for a Malaysian shipyard in a claim for unpaid amounts due under a jack-up rig repair and modification contract.
    • Assisting an FPSO owner in relation to its claims for unpaid charter hire against the operator, where the operator’s non-payment was based on the alleged underperformance of the FPSO.
    • Advising the buyer in relation to its termination of three shipbuilding contracts, citing extensive welding defects and excessive delay to delivery.
