WFW wins in the Italian Council of State on behalf of Haemonetics Italia

12 April 2013

Watson, Farley & Williams (“WFW”), a leading international law firm, is pleased to announce that it has won a victory at the Italian Council of State on behalf of the blood management company Haemonetics Italia Srl (“Haemonetics”).

WFW Milan partner and administrative law specialist Cristina Martorana represented Haemonetics while Galileo Manzi defended the hospital Azienda Ospedaliera Universitaria of Ancona.

The case arose following a challenge to Azienda Ospedaliera’s decision to award Haemonetics the tender for a five-year contract to supply hospital diagnostic services as well as produce therapeutic devices for the inter-regional department of transfusion medicine.

Although the tender win was attributed to Haemonetics’ vast inventory of new generation devices and its ability to meet the Italian public healthcare budget requirements, Paco Srl brought the case to court to challenge the award. The resulting legal battle has now been won for Haemonetics by Watson, Farley & Williams.

WFW Milan partner Cristina Martorana commented: “The speed with which certain disputes can be settled in the public procurement sector gives certainty to the complex contractual relations between pharmaceutical companies and public administrations. We are delighted we could assist our client in reaching a successful outcome to this case.”
