WFW successfully defends Winch Energy against Svicat

Watson Farley & Williams (“WFW”) is pleased to announce that it has successfully advised Winch Energy (“Winch”), a major energy company focusing on both free-standing and roof-mounted solar power generation, operating in the UK, France and Italy. The advice is in relation to a successful defence of a litigation proceeding commenced by Svicat Energy, an Italian company specialising in the production of photovoltaic plants.

The proceeding was related to a request of payment submitted by Svicat for a presumed restoration of damages deriving from an alleged breach of the agreement related to the transfer of nine photovoltaic plants from Svicat Energy to Winch’s portfolio, subject to a financing condition precedent for Winch Energy.

The Court of Rome has dismissed all the demands of the plaintiff, having considered that the condition precedent had not been satisfied without any Winch bad faith or negligent conduct.
